Manipulation of the Constitution

Secular authoritarians insist upon what they call a "living constitution" that has an open-minded disconnect from moral absolutes.  As has been attributed to Dostoevsky among others, "If God is dead, then anything is permitted."  The colossal failure of secularized education flowing from teachers unions and tenure privileges, which subordinates citizen sovereignty, is the damning consequence of atheistic-secular politics.  The Constitution becomes a mere political document for manipulation by authoritarians who show themselves to be enemies of family, human dignity and limited government.

 

Regardless of the arguments advanced by those who reject the intent of the Constitution, the Rule of Law means that the government is limited in all of its actions by the rules fixed and ratified beforehand.  This is the context within which legislation, court decisions and administrative directives at all levels of government must fit.

 

For those who deny the important role of morality, here is its meaning from Merriam-Webster:  "a: of or relating to principles of right and wrong in behavior:  ETHICAL <moral judgments>; b: expressing or teaching a conception of right behavior <a moral poem>; c: conforming to a standard of right behavior; d: sanctioned by or operative on one's conscience or ethical judgment <a moral obligation>; e: capable of right and wrong action <a moral agent>.

 

Americans determined to protect liberty reject the "living constitution" because it leaves society vulnerable to political deception.  Constitutional government by "written and permanent law" requires an amendment that is acceptable to the people before a change in its provisions is acceptable.  Faithfulness to this process protects society from political deception and the convolution associated with government by incalculable and changeable decrees.

 

Those who reject the rule of law based upon moral absolutes are like ships without an anchor.

This drift is illustrated by judicial decisions that set precedents ignoring and overriding the meaning of the Constitution.  An example of the foolishness of the rule of man rather than the rule of law is the US Court of Appeals for the Ninth Circuit's ruling on November 2, 2005, that parents' fundamental right to control the upbringing of their children "does not extend beyond the threshold of the school door," and that a government school has the right to provide its students with "whatever information it wishes to provide, sexual or otherwise" (Fields v. School District, No. 03-56499, D.C. No. CV-03-00457-JVS).  This unconscionable judge-made law further strengthens the arms of union bosses, leftist teachers and radicals, if any, on school boards.

 

American conservatism transcends both the good and evil intentions of today’s adherents to the old European secular philosophy—the religious and political left.  Revisionist morality, supported by the Darwinian theory for life’s origin, meaning, and purpose, represents one of the greatest evils of our time.*  A focus upon the danger to American liberty can be narrowed to those who are at the seat of the problem—secular militarists.

 

American exceptionalism, the tradition of citizen self-reliance, and the liberty that comes with limited government CAN be restored.

 

 

 

*Charles Darwin published his theory for a God-rejecting worldview in the book The Origin of Species, published in 1859.  There is some adaptation within species, but the Herculean efforts of science pretenders to find evolution between species fail.  Sir Arthur Keith, a leading evolutionist has written:  “Evolution is unproved and unprovable.  We believe it only because the only alternative is special creation which is unthinkable” (Sir Arthur Keith, as citation in Wallie A. Criswell’s Did Man Just Happen? Grand Rapids MI:  Zondervan, 1972, p. 73; D. M. S. Watson acknowledged the same in Nature, vol. 124, August 10, 1929, pp. 231-234).

Ban the Ten Commandments? What For?

The laws of creation's nature include the perimeters for civil behavior provided by the Ten Commandments (Exodus 20 and Deuteronomy 5).  Because of the universal benefits that come from applying the Commandments, they are a common part of the moral religions throughout the world.  Prior to the time that supremacist judges embraced the intolerance of a tiny minority (the laws of man), the rest of us had the benefits that come when the Commandments were emphasized in the schools and on public properties throughout the nation.

 

 

Americans recognize that the promotion of life-building attitudes is important, but that it is not right to punish harmful attitudes that have not been expressed by criminal actions.  "We, The People" places the consequences of attitudes, good or bad, in the hands of God.  He sees and hears all.  Over time, the failure to police one's own thoughts renders severe punishments in direct proportion to the evil committed.  These six commandments pertain directly to such matters of the heart:


You shall have no other gods before Me.

You shall not make for yourself a graven image.

You shall not take the name of the LORD your God in vain.

Remember the Sabbath day, to keep it holy.

Honor your father and mother.

You shall not covet your neighbor's house; you shall not covet your neighbor's wife, nor his male servant, nor his female servant, nor his ox, nor his donkey,  nor anything that is your neighbor's.

 

Four of the commandments provide the foundation for civil and criminal law in America:


You shall not murder (the right to life).

You shall not commit adultery (the sanctity of marriage).

You shall not steal (the right to own property).

You shall not bear false witness against your neighbor (the right to be truthfully represented).

 

It is citizen support for moral absolutes reflected in the Ten Commandments that promotes the passage of good laws by elected representatives.  It is, exclusively, this moral climate within our society and government that can prevail over the curse of moral relativism practiced by the masters of political deception.

 

 

To justify taxpayer support, educators must teach the truth about the God-honoring Declaration of Independence and Ten Commandments that have enabled Americans to change a wilderness into the greatest nation on earth.

Ban the Bible? What For?

The benefits of the Bible to society and governments were recognized by the Founding Fathers.  The Bible was "recommended to American citizens by the Confederation Congress on September 12, 1782" (James H. Hutson, Religion and the Founding of the American Republic, Washington, DC: Library of Congress, 1998, Preface and pp. 57-58).

 

God's standard for truth is the most fundamental moral category in the universe.  Truth separates traditional American values (theistic belief) from the old European secular philosophy (atheistic belief about life's origin, meaning and purpose).  Abel, who had chosen to follow the God of absolute truth, was slain by Cain, who, abiding by the impulses of the flesh, had chosen to follow his own version of truth.  It is this same war of divergent cultures that is now raging between the "In God We Trust" of Americans and the cultish atheism of old European secular philosophy.

 

During the controversy over the French Revolution, Edmund Burke wrote in response to the question, "What is liberty?"  He stated:  "Mere liberty without other forces working in the sphere that it opens up is only another name for license" (Edmund Burke, Reflections on the Revolution in France, 1790, London: Henry G. Bohn, 1864 extract, 129).

 

The sovereignty of our constitutional government is clearly made subordinate to the sovereignty of certain God-given rights of the citizens who ratified it.  This distinguishes the meaning of liberty for individuals in America.  They can exercise their independence and capacity to make better and differing decisions.  What a contrast from the demands of secular academician with communistic, socialistic and liberal leanings!  They reject the citizen's capacity for self-rule and expect conformity to cultish political correctness based upon changeable decrees.

 

The Bill of Rights law is spiritual in the sense that it upholds the unalienable right of the people to follow God's prescription for happiness without fear of authoritarian reprisals.  The idea is economic as well, because people, having the right to life, also have the right to work and to use the fruits of their labor to sustain life.

 

The God of creation is identified by the Bible as the "Good Shepherd."  It is this same God who gave the Ten Commandments to mankind through Moses.  A good shepherd does not dictate and control.  When a lamb falls and breaks its leg, the shepherd will place a splint on the leg and carry the lamb until it heals.  Then, hoping the lamb has learned a lesson, the shepherd allows it to run again when able.  God admonishes, but unlike those allied with Satan, He will not deceive and seek to by-pass a person's common sense to force worldly compliance (atheistic political correctness).

 

When our government allows, based upon its original constitution, the freedom of Americans to align their lives according to the precepts of God's Word, its citizenry can prosper under the Good Shepherd's protection.  Choosing the benevolent God of the Bible as one's own shepherd of life is, of course, a personal decision; but when that choice is made, the lamb is under God's protection and learns self-control as he follows the Good Shepherd.

Biblical Government

When the early Americans searched their Bibles to learn about government, what did they find?

 

The first level of government is individual self-government.  Lasting success comes by giving attention to God's standards, the laws of creation's nature that were the norm before man's rebellion opened the door for Satan's influence (Exodus 20:1-17, Romans 13:13-14).  Big government, the abundance of police, prisons, and hospitals are the consequences of sinful life practices.  When man restrains his own selfish impulses and desires, the tyranny and exploitation of big government can be avoided.

 

The second level of government is the family.  From the beginning, it has been the holy commitment of one man and one woman in marriage that has defeated the will of Satan in his war against civilization (Genesis 2:18-24).  God instituted marriage to facilitate companionship and the nurturing of children in the truth.  The husband cares for his wife in a loving way and she respects him (Ephesians 5:22-23).  Parents are responsible for the education of their children.  By learning to honor and obey their parents, children also learn to honor the lordship of God and become responsible citizens (Ephesians 6:1-4, Proverbs 15:5).  The Bible makes it clear that property ownership and wealth come through labor, while laziness produces poverty (Proverbs 10:4-5).  Recognition of this aspect of the laws of creation's nature benefits families (1 Timothy 5:8, Proverbs 31:13-27).

 

The third level of government is the voluntary union of people belonging to a church, churches of different denominations to edify citizens through biblical principles for faith and community (1 Timothy 5:17) and discipline (Matthew 18:16-19).  Churches also have the biblical mandate to be societal caregivers (1 John 3:17).  Families and churches are united in the promotion of citizen self-reliance and limited civil governments.

 

The fourth level of government is civil government on local, regional and national levels.  Its prime function is to protect the citizens from criminals inside and outside government and from external aggression (Romans 13:1-4, 1 Peter 2:13-14).

Natural Law vs. Secular Law

The natural-law philosophy, foundational to the American constitution, is in direct conflict with secular law.

 

The atheistic-secular philosophy for law identifies with what Solon of Athens described as "government by incalculable and changeable decrees" (Will and Ariel Durant, The Story of Civilization, Vol. II, The Life of Greece, Simon and Schuster, 1939, 118).  No ~ a solid basis is necessary for prosperity and the self-government enablements of man, for which the Constitution was written.  Secular law leads to political adventurism, exploitation, death and slavery.

 

Separation of the three branches of government (checks and balances) is vital, but what about the Declaration of Independence pattern for separation from hierarchical rule?  This is outlined in the Bill of [citizen] Rights and intended to prevent government servants from perverting established law to grant rights that are harmful to the public.  They are also intended to prevent government servants from using the public's treasury to subsidize slothful citizens and thereby attract an irresponsible voting block.  

"Liberty and security in government depend not on the limits, which the rulers may please to assign to the exercise of their own powers, but on the boundaries, within which their powers are circumscribed by the Constitution.  With us, the powers of magistrates, call them by whatever name you please, are the grants of the people…  The supreme power is in them [the people]; and in them, even when the Constitution is formed, and government is in operation, the supreme power still remains.  A portion of their authority they, indeed, delegate; but they delegate that portion in whatever manner, in whatever measure, for whatever time, to whatever persons, and on whatever conditions they choose to fix" (Supreme Court Justice James Wilson, Lectures, 1790-1791).

 

The limited purpose for judicial independence is to enable judges to settle disputes without being pressured by special interests.  When judges establish policies by legislating or administrating, they have seriously violated their jurisdiction and become fascistic.  That is, they are overriding and preventing the people as sovereigns whose exclusive authority it is to elect like-minded representatives to do the legislating and serve as administrators. 

 

"The great object of my fear is the federal judiciary.  That body, like gravity, ever acting, with noiseless foot, and unalarming advance, gaining ground step by step, and holding what it gains, is engulfing insidiously the special governments into the jaws of that which feeds them."*  Upholding the intent and meaning of "certain unalienable [supreme] rights" of the people, outlined in the Declaration of Independence and the Bill of Rights, is indispensable.  Laws that protect sodomy, same-sex marriage, abortion, and the privileges of teacher tenure are a violation of essential American principles that protect the public from exposure to unsavory and virulent evil practices.  On the other hand, laws that protect a strong, responsible citizen majority are crucial to the survival of self-government and liberty from tyrannical government rule.  

 

As long as judges do not use their independence to twist the meaning of the Constitution and the Bill of Rights to mask an authoritarian secular agenda, the American principles for life and liberty are not impaired or diminished.  All citizens, including judges, have the duty to protect the unalienable God-given rights to life and responsible use of liberty for others.

American Principle Six: The Written Constitution Established By Americans Is a Tool For Governing

We, the people, have as our guide God-honoring principles for directing the use of government power.  When, during the Civil War, Abraham Lincoln dedicated the field where thousands gave their lives at Gettysburg, he concluded, "that this nation, under God, shall have a new birth of freedom--and that government of the people, by the people, for the people, shall not perish from the earth" (The Gettysburg Address, Gettysburg, Pennsylvania, November 19, 1863).

 

Americans established government when covenanting to share a small portion of their God-given rights to use force and keep thieves out of the corncrib.  It is the tax revenues provided by the people that give government its power.  

 

The tool is to be used in ways to achieve the goals spelled out philosophically in the Preamble:  "We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare [meaning common needs that do not conflict with or hamper the development of the work ethic and personal self-reliance] and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."

 

Some delegates to the Constitutional Convention believed these principles of the Declaration of Independence for guiding government action would prevail without amending the Constitution because many states had already adopted a Bill of Rights.  Obviously the delegates did not anticipate the pervasiveness of the federal judiciary as it has since developed.  Ultimately the Founding Fathers at the state level made a most significant contribution by insisting that the nation's Constitution be amended by a Bill of Rights.

American Principle Two: God Is the Source of Unalienable Rights

Belief in a Higher Authority also believes in the opposite side of the coin:  that man does not originate law, God does.  Legislators articulate this pre-existing law and give it particular applications to changing circumstances.

 

During the 1765 crisis caused by the king's Stamp Act, John Adams, when writing the Dissertation on the Canon and Feudal Law, August 12, 1765, the Boston Gazette, pointed out that liberty was not man's creation or something radically new to the world, but rights "derived from our Maker," rights "indisputable, unalienable," "inherent," "essential," "divine" and even acknowledged since the Middle Ages by British law.

 

"We further recommend the most clear and explicit assertion and vindication of our rights and liberties to be entered on the public records, that the world may know, in present and all future generations, that we have a clear knowledge and a just sense of them, and, with submission to Divine Providence that we never can be slaves" (John Adams, pictured below, adopted on October 14, 1765, by the town meeting of Braintree, Massachusetts, and sent to their representatives in the Massachusetts state legislature).

 

Those who reject God's authority and proceed to fix the rights of others are, by definition, false gods and, in practice, become tyrants.  Alexander Hamilton, in The Federalist, No. 78, says:  "A constitution is, in fact, and must be regarded by the judges, as a fundamental law."  When a particular statute violates the meaning of the Constitution, it is the duty of judicial tribunals to disregard it and adhere to the Constitution.  

 

"The sacred Rights of mankind are not to be rummaged from among old parchments or musty records.  They are written, as with a sunbeam, in the whole volume of human nature, by the Hand of the Divinity itself, and can never be erased or voided or obscured by mortal power" (teachingamericanhistory.org, Alexander Hamilton, The Farmer Refuted, 1775).

 

Education in America today is energizing the enemies of the family, self-rule, prosperity and liberty because it does not emphasize that man’s unalienable rights are the gift of God.

Censorship of Christmas in Public Schools

Permit me one interruption of my discussion of immortal American Principles ...

 

Secular militants have shut down ideological competition by preventing religious, political and academic freedom on many campuses throughout the nation.  Haters of citizen self-government in America are effectively muting the voices of tens of thousands of concerned citizens.  

 

The war against the Judeo-Christian foundation for American law, self-government and the spirit of liberty extends beyond leftist radical censorship of American history and foundational American beliefs from public school textbooks.  "A decorated pine tree in the Ames High School cafeteria has been taken down because of complaints from a high school employee and some parents" (The Tribune, December 4, 2010).  Reporting the words of the school Superintendent, "We are in the business of educating students.  I didn't want this [decorated pine tree] to become a distraction … so we decided it would be best to take down the tree."  His frankness about a few people who were intolerant of a pine tree within the sight of students is commendable.  The tree was in the school for the traditional Christmas season, but apparently they dared not even call it a Christmas tree.

It is needful that we reject the spirit of rebellion and enjoin the spirit of truth that empowers man to storm the strongholds of evil.  It is spiritual wisdom that enabled this nation to become the most blessed civilization in history.  The restoration of spiritual glory--the potential to reassert our culture's values of freedom, education, prosperity, and truth--is at hand.

In God We Trust (Except In Public Schools)

Having confronted the barriers to success imposed by the British Crown at the First Continental Congress, the Founding Fathers needed to address the following questions:

I.               How do we bring into focus the justification for independence that can, in fact, support the life, liberty and happiness that the colonists found possible?

II.             How do we declare the sovereignty of man under God over government, upon which respect for impartial law, citizen self-rule and liberty are justified?

III.           How do we emphasize the need for strict separation from the British king and other pretender gods, who have managed to betray and exploit mankind down through history?

IV.            What must we proclaim that will convince other nations to have confidence in the United States as a sovereign entity?

The answers to these questions became the basis for the unique principles for government in America.  The Declaration of Independence provided a moral and just basis for law as no other document before or since.  These principles were adopted unanimously by the Second Continental Congress on July 2, 1776.  On July 4, 1776, the delegates signed their names to the Declaration, and the new nation—independent from Great Britain—was born.

What is the common bond that enabled Americans to establish the greatest nation on earth?  The USA Today/Gallup Poll published May 6, 2010 reports that 92 percent of Americans believe in God and only 5 percent said they oppose the National Day of Prayer.  The problem is that public schools stopped teaching how the basic American belief “In God We Trust” translates into principles for political decisions that made America the overwhelming choice of immigrants from around the world.

True Patriotism

In his Farewell Address, Washington reminded Americans that:

"Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports. In vain would that man claim the tribute of patriotism, who should labor to subvert these great pillars of human happiness, these firmest props of the duties of men and citizens. The mere politician, equally with the pious man, ought to respect and to cherish them."

Knowledge of the Bible, the Great Reformation (1517-1648), and the American experience inspires individuals to become self-governing and, on a broader scale, inspires communities and the nation as a whole to overcome the tyranny of moral confusion.  Even the German atheist Friedrich Nietzsche understood the source of freedom for his way of life when he wrote:  "Remove Christianity and the ideas fall too."  (Cited by Dinesh D'Souza, "Created Equal:  How Christianity Shaped the West," Hillsdale College Imprimis, November 11, 2008.)

Failure to acknowledge the benevolent laws of God and creation's nature and conform to moral truth guarantees harmful consequences.  When God's benevolent provision is rejected in any particular, the rejecter bears the price of that sin against himself and the will of God.

 

A most insightful analysis has been presented by Marvin Olasky.  As a Marxist intellectual, he was highly regarded by the chairman of his PhD academic program and dissertation committee at the University of Michigan.  Marvin Olasky, who became disillusioned by the shallowness of socialistic panaceas, became a solid convert to Christianity.
