Government by Written and Permanent Law: Stability vs Manipulation

The most significant correction that came with the American Revolution was that citizens themselves were recognized as sovereigns under God over government.  In the United States, people looked to creation's God for higher authority.  The First Amendment rejection of power, claimed by government authoritarians, kings, academians, clergy, etc., unleashed competition for religion, education and speech among the people that enabled America to become the greatest nation in world history.

 

William Ellery Channing wrote, "Erase all thought and fear of God from a community, and selfishness and sensuality would absorb the whole man.  Appetite knowing no restraint, and poverty and suffering having no solace or hope, man would trample in scorn on the restraints of human laws.  Virtue, duty, principle would be moved and scorned as unmeaning sounds.  A sordid self-interest would supplant every feeling, and man would become… a companion of brutes."*

 

"Government by written and permanent law" is not complicated.  No matter what one's religion, birthright or political view, the principles of the Declaration and universal absolutes shown here clearly distinguish right from wrong.  Stealing property that belongs to another is violating an unalienable right upon which liberty depends.  Adultery is a violation of the sacred obligations of marriage and family, creating stress and shortening life.  Dishonesty cheats the victim out of an unalienable, God-given right and undermines the reliable communication upon which commerce and community depend.  Deliberately stopping the heart of an unborn child is an horrific offense to the God of life as well as to society.

 

How then can the people protect themselves from cavalier authoritarians who manipulate changes in laws that enable radicals to dumb down students and, by extension, over time, manipulate society?

 

Historians Will and Ariel Durant pointed out Solon of Athens' recognition of the critical procedural choice that is directly related to limiting the options for political deception.  Do we insist upon "government by written and permanent law," or do we permit "government by incalculable and changeable decrees?"**

 

Impressions of Solon of Athens and other lawmakers from different cultures, with the focus on Moses and the Ten Commandments, are displayed on the Supreme Court building in Washington, DC.  Although Solon did not support his understanding with references to the Old Testament for reliable standards, he did recognize the ongoing dangers of deception by authoritarians who manage to dominate soft sciences.

 

"Government by written and permanent law" provides long-term stability.  Mankind is protected from short-lived popular fantasies and preserved from the inroads of political deception.  Secular elitists who insist that the American charter for the use of government power is a "living constitution" now artfully advance "government by incalculable and changeable decrees."  To retain respect for the family and liberty, the Constitution must be anchored to the political truth adopted by the Founding Fathers.

Old European Secular Philosophy vs Family

Karl Marx attacked the family.  He appealed to academia and others for the "abolition of the family."  "The bourgeois clap-trap about the family and education, about the hallowed correlation of parent and child" is "disgusting."*

 

Dr. John Dewey, a proponent of teacher employment guarantees at taxpayer expense, is the acknowledged father of modern-day public education.  He was an admirer of Margaret Sanger, Humanist of the Year in 1967 and the founder of Planned Parenthood.  Sanger also founded the publication The Woman Rebel, whose slogan was "No Gods! No Masters!"  Her first edition denounced marriage as a "degenerate institution" and sexual modesty as "obscene prudery" (George Grant, Legacy of Planned Parenthood, Wolgemuth & Hyatt Publishers, Inc).

 

Judith Stacey, a highly regarded member of the public school primary and secondary education faculty at the University of California (Davis campus), declared:  "The 'family' is not here to stay.  All democratic people, whatever their kinship preferences, should work to hasten its demise" ("Rights and Rites," The Washington Times, March 29 1993). Since the Supreme Court decision Everson v. Board of Education in 1947, tenured radical teachers have sought to take God out of education and ultimately turn the tide of education against the family.  

 

It is the collective political power granted to monopoly teacher unions and the establishment of tenure laws that empower the enemies of the family, human dignity, and self-government.  Tenured secular authoritarians have achieved control of curriculum used in the soft sciences and the study of law taught in government schools.  The weapons they use to enforce what must be taught include the ridicule and denigration of the reputation of anyone who dares to challenge leftist political correctness.  The use of the word "science" is code for their atheistic human origins, meaning and purpose; "diversity" is code for demanding the approval of evil life practices; and "social justice" is code for using government power to force the transfer of wealth from the thrifty to their own block of voters. 

 

"These [atheist] teachers must embody the same selfless dedication as the most rabid fundamentalist preachers, for they will be ministers of another sort, utilizing a classroom instead of a pulpit to convey humanist [atheistic] values in whatever subject they teach, regardless of the education level--preschool, daycare or large state university.  The classroom must and will become an area of conflict between the old and the new--the rotting corpse of Christianity" (The Humanist, January/February, 1983).

 

The change in the American family since the 1947 Supreme Court decision in Everson v. Board of Education, teacher unionization and tenure law has led to a colossal increase in family breakdown (See April 6 2012 blog entitled "Public Education Shuns Reality").

A Letter To My Grandchildren

More than one of you have faced a challenge from your college professors or spiritual mentors that the War of Independence was "throwing off the government that God has placed upon you."  Some theologians do take that position according to Daniel 2:21, "He changeth the times and the seasons: He removeth kings, and setteth up kings …"  A similar reference to this is, "Let every soul be subject unto the higher powers.  For there is no power but of God; the powers that be are ordained of God.  Whosoever therefore resisteth the power, resisteth the ordinance of God…" (Romans 13:1,2).

 

I would agree ~ IF the King of England had been proceeding according to written law.  

 

Following the British "Glorious Revolution" of 1688 and the ascension of William and Mary as joint monarchs, the proposal to draw up a declaration of subjects' rights and liberties was made in the House of Commons.   The completed declaration was codified as the British citizens' Bill of Rights in 1689.  Among the "ancient rights and liberties" asserted were "the right of the subject to petition the king and prosecutions for petitioning are illegal" as well as "subjects may have arms for their defense suitable to their conditions and allowed by law" and "excessive bail and fines shall not be required and cruel and unusual punishments are not to be inflicted."  There was an internal change of constitution following the excesses of James II.*

 

These laws protected the citizens' right to petition the King without fear of retribution.  He and his subordinates were repeatedly violating this and the citizens' right to freedom.

 

One hundred years later, Edmund Burke (1729-1797), a British statesman and orator, commented on this internal change of the British constitution by saying, "The Revolution was made to preserve our ancient indisputable laws and liberties, and that ancient constitution of government which is our only security for law and liberty."*  He opposed the King's efforts to suppress American independence.  

 

For years our Founding Fathers tried to negotiate reasonableness; but the British response was an iron fist, including the placing of troops on the coast.  Eventually negotiations between the colonists and the King collapsed.  Written like a legal brief, the Declaration of Independence detailed how their rights as British citizens were being violated.  They are "… taking away our charters, abolishing our most valuable laws, and altering fundamentally the forms of our governments" (Declaration of Independence).

 

"The spirit of encroachment tends to consolidate the powers of all the departments in one, and thus to create, whatever the form of government, a real despotism.  A just estimate of that love of power, and proneness to abuse it, which predominates in the human heart, is sufficient to satisfy us of the truth of this position" (President George Washington, Farewell Address, 1796).

 

Government employees are servants of the people who are the sovereigns under God over government.  The American Declaration of Independence and citizens' Bill of Rights, added later to the Constitution, provides the God-honoring design for government, and the Constitution is the tool for implementing that design.

 

Americans concurred with written law resting upon the British references to the Laws of Nature.  It is the governing character of Laws of Nature such as humility, the Golden Rule and the Ten Commandments, that lead to success.  This is the sure foundation upon which man's right to "life, liberty, and the pursuit of happiness" rests.  Called "virtue" by America's Founding Fathers, the impartial and divine element frees man to do what is right.  "Where the Spirit of the Lord is, there is liberty" (2 Corinthians 3:17).

 

I identify with and support the several Norris ancestors who fought for independence.  Keep up the good work as students, my children.  I love you.

Biblical Government

When the early Americans searched their Bibles to learn about government, what did they find?

 

The first level of government is individual self-government.  Lasting success comes by giving attention to God's standards, the laws of creation's nature that were the norm before man's rebellion opened the door for Satan's influence (Exodus 20:1-17, Romans 13:13-14).  Big government, the abundance of police, prisons, and hospitals are the consequences of sinful life practices.  When man restrains his own selfish impulses and desires, the tyranny and exploitation of big government can be avoided.

 

The second level of government is the family.  From the beginning, it has been the holy commitment of one man and one woman in marriage that has defeated the will of Satan in his war against civilization (Genesis 2:18-24).  God instituted marriage to facilitate companionship and the nurturing of children in the truth.  The husband cares for his wife in a loving way and she respects him (Ephesians 5:22-23).  Parents are responsible for the education of their children.  By learning to honor and obey their parents, children also learn to honor the lordship of God and become responsible citizens (Ephesians 6:1-4, Proverbs 15:5).  The Bible makes it clear that property ownership and wealth come through labor, while laziness produces poverty (Proverbs 10:4-5).  Recognition of this aspect of the laws of creation's nature benefits families (1 Timothy 5:8, Proverbs 31:13-27).

 

The third level of government is the voluntary union of people belonging to a church, churches of different denominations to edify citizens through biblical principles for faith and community (1 Timothy 5:17) and discipline (Matthew 18:16-19).  Churches also have the biblical mandate to be societal caregivers (1 John 3:17).  Families and churches are united in the promotion of citizen self-reliance and limited civil governments.

 

The fourth level of government is civil government on local, regional and national levels.  Its prime function is to protect the citizens from criminals inside and outside government and from external aggression (Romans 13:1-4, 1 Peter 2:13-14).

American Principle Three: Upholding the Traditional Family Is Paramount

Protecting the traditional family as a distinct institution is among the highest priorities for a nation's laws.  This historic arrangement has proven overwhelmingly to be the best setting for raising children to live healthy, responsible and productive lives (Genesis 2:23-24).

American Principle Two: God Is the Source of Unalienable Rights

“All men are … endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness.”

Belief in a Higher Authority also believes in the opposite side of the coin:  that man does not originate law, God does.  Legislators articulate this pre-existing law and give it particular applications to changing circumstances.

 

During the 1765 crisis caused by the king's Stamp Act, John Adams, when writing the Dissertation on the Canon and Feudal Law, August 12, 1765, the Boston Gazette, pointed out that liberty was not man's creation or something radically new to the world, but rights "derived from our Maker," rights "indisputable, unalienable," "inherent," "essential," "divine" and even acknowledged since the Middle Ages by British law.

 

"We further recommend the most clear and explicit assertion and vindication of our rights and liberties to be entered on the public records, that the world may know, in present and all future generations, that we have a clear knowledge and a just sense of them, and, with submission to Divine Providence that we never can be slaves" (John Adams, pictured below, adopted on October 14, 1765, by the town meeting of Braintree, Massachusetts, and sent to their representatives in the Massachusetts state legislature).

 

Those who reject God's authority and proceed to fix the rights of others are, by definition, false gods and, in practice, become tyrants.  Alexander Hamilton, in The Federalist, No. 78, says:  "A constitution is, in fact, and must be regarded by the judges, as a fundamental law."  When a particular statute violates the meaning of the Constitution, it is the duty of judicial tribunals to disregard it and adhere to the Constitution.  

 

"The sacred Rights of mankind are not to be rummaged from among old parchments or musty records.  They are written, as with a sunbeam, in the whole volume of human nature, by the Hand of the Divinity itself, and can never be erased or voided or obscured by mortal power" (teachingamericanhistory.org, Alexander Hamilton, The Farmer Refuted, 1775).

 

Education in America today is energizing the enemies of the family, self-rule, prosperity and liberty because it does not emphasize that man’s unalienable rights are the gift of God.

Censorship of Christmas in Public Schools

Permit me one interruption of my discussion of immortal American Principles ...

 

Secular militants have shut down ideological competition by preventing religious, political and academic freedom on many campuses throughout the nation.  Haters of citizen self-government in America are effectively muting the voices of tens of thousands of concerned citizens.  

 

The war against the Judeo-Christian foundation for American law, self-government and the spirit of liberty extends beyond leftist radical censorship of American history and foundational American beliefs from public school textbooks.  "A decorated pine tree in the Ames High School cafeteria has been taken down because of complaints from a high school employee and some parents" (The Tribune, December 4, 2010).  Reporting the words of the school Superintendent, "We are in the business of educating students.  I didn't want this [decorated pine tree] to become a distraction … so we decided it would be best to take down the tree."  His frankness about a few people who were intolerant of a pine tree within the sight of students is commendable.  The tree was in the school for the traditional Christmas season, but apparently they dared not even call it a Christmas tree.

It is needful that we reject the spirit of rebellion and enjoin the spirit of truth that empowers man to storm the strongholds of evil.  It is spiritual wisdom that enabled this nation to become the most blessed civilization in history.  The restoration of spiritual glory--the potential to reassert our culture's values of freedom, education, prosperity, and truth--is at hand.

American Principle One: The Spiritual Nature of Man is Supreme

There is a definite, unique, American belief that translates into specific principles for the establishment and workings of our government.  It can be found in the Declaration of Independence. 

James Wilson was one of six men who signed the Declaration of Independence and the Constitution of the United States.  Addressing the Pennsylvania Ratifying Convention for the new constitution, Wilson read the Declaration of Independence and then he stated:  “This [Declaration] is the broad basis on which our independence [from authoritarian rule] was placed; on the same certain and solid foundation this [the Constitution of the United States] system is erected.”*

This begins a discussion of immortal principles central to liberty and American greatness as found in the Declaration of Independence.   Compromise of any of the following principles leads to harmful consequences.

American Principle One:  The Spiritual Nature of Man Is Supreme

Foundational to liberty and the American approach to government is the fact that man is of divine origin.  His spiritual or God-honoring nature is held as being of supreme importance.  Upholding man’s God-given “rights” from abuses sanctioned by governments makes liberty possible.  The divine quality of these rights calls for the unequivocal rejection of the authoritarian entitlements claimed by elitists of all stripes—kings, authoritarian politicians, clergy, educators, and militarists.  This principle enshrines certain limits that must, for the sake of liberty, be placed upon the use of the law and government power.

Humble support for the sovereignty of man under God over government is the guarantor of freedom for family wholeness, self-reliance, and prosperity.  People who know the truth can reject, without fear, the alarming chatter of atheistic sectarians.

Yesterday's Foundation for Today's Liberty

From the beginning, Judeo-Christian principles have been the

foundation for American public dialogue and government policy. They

serve as the solid basis for political activism in support of a better

socioeconomic environment. Found in American homes, truth from

the Hebrew Christian Bible has enabled individual liberty to prevail
